Concerted practices
Competition authorities rely on the
presumption of a concerted practice among companies in
case of parallel behavior witnessed in the relevant
market. Economic analysis then becomes indispensable
to challenge this claim. It is used to determine
whether there is an economic explanation for the
witnessed behavior based on the market structure. In
such cases, a simulation of the market in question is
generally undertaken and the predictions of the model
are compared with the actual outcome. |
